Detached work: dysfunctions persist

Always current, dysfunctions against the fraud with detached work persist.

In an annual public report, the Court of Auditors considers that the legal framework against posted work fraud has been strengthened. However, there are still gaps in the sanctions. European side, the TRM expects a clarification on the detached work included in the mobility package (the plenary vote is scheduled for March)

Reminder : the revised 1996 Directive was adopted by the European Parliament and the Council on 28 June 2018 excludes road transport and will apply from 30 July 2020.

What dysfunctions put forward :

• rules on detached work that are robust but difficult to apply
• a lack of means and tools for controlling these rules
• a period of cooperation between Member States that is too long
• the “flexibility” of sanctions in case of fraud
